Section 01
Account usage
You must provide accurate information when creating an account, keep your credentials secure, and notify Margin Kitchen promptly of any unauthorized access. Each user must have their own credentials — shared logins are not permitted.
Section 02
Acceptable use
Margin Kitchen is a tool for restaurant operators. You agree not to:
- Use the service to violate any applicable law or third-party right.
- Reverse-engineer, scrape, or attempt to extract proprietary models or other customers' data.
- Upload data you do not have the right to upload.
- Resell, white-label or sublicense the service without a written agreement.
- Disrupt, overload or attempt to compromise the security of the service.
Section 03
Subscription, cancellation, and refunds
Paid plans are billed per location on a monthly or annual cadence as selected at checkout. Upgrades take effect immediately and are pro-rated; downgrades take effect at the next renewal.
Cancellation requires 30 days' written notice, which you can submit from billing settings or by emailing ops-support@marginkitchen.com. Monthly plans stop renewing at the end of the current cycle. Annual plans are not refunded on a pro-rata basis — the plan stays active through the paid term and does not renew.
Applicable taxes are added at checkout based on the billing address on file.
Section 04
Data ownership
You own your restaurant operational data. You grant Margin Kitchen a limited license to process that data solely to provide the service to your organization, generate the outputs you request, and maintain the security and integrity of the platform. We do not sell your data. We do not use it to train cross-customer models without your explicit, written consent.
Section 05
User responsibilities
Margin Kitchen produces recommendations. The decisions a manager makes — what to prep, who to staff, what to re-price — remain the responsibility of the operator. You are responsible for compliance with employment, food safety and other laws applicable to your business.
Section 06
Limitation of liability
To the fullest extent permitted by law, Margin Kitchen is not liable for indirect, incidental, or consequential damages arising from use of the service. Aggregate liability for any claim is capped at the fees paid by the customer to Margin Kitchen in the twelve months preceding the event giving rise to the claim.
Customers indemnify Margin Kitchen against third-party claims arising from data they upload or operational decisions they take based on recommendations.
Section 07
Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Disputes are resolved in the state or federal courts located in Hillsborough County, Florida.
Section 08
Service availability
We operate on redundant AWS infrastructure with scheduled maintenance communicated in advance. We do not guarantee uninterrupted service. Status and incident history are published on our public status page.
Section 09
Termination
You may cancel your subscription at any time from billing settings or by contacting ops-support@marginkitchen.com. We may suspend or terminate access for violation of these terms, with reasonable notice where possible. After termination, your data is retained for the limited window described in the privacy policy and then deleted.
